Terms of Service

1. Preamble and Acceptance
Welcome to Sehat Doc. This agreement ("Terms") governs your access to and use of the Sehat Doc clinical management platform, including all associated websites, mobile applications, and cloud-based services (collectively, the "Service").
By registering for an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you are entering into this Agreement on behalf of a clinic, hospital, or other legal entity, you represent and warrant that you have the legal authority to bind such entity to these Terms. If you do not agree to these Terms, you must not access or use the Service.
2. Eligibility and Professional Status
The Service is intended for use by licensed medical practitioners and healthcare administrative staff in the Islamic Republic of Pakistan. By using the Service, you represent and warrant that:
- You are at least 18 years of age and possess the legal capacity to enter into this contract.
- You hold a valid license to practice medicine or operate a healthcare facility issued by the Pakistan Medical Commission (PMC), Pakistan Medical & Dental Council (PMDC), or relevant Provincial Healthcare Commissions (e.g., PHC, SHCC, KP-HCC, BHCC).
- You will notify us immediately if your professional license is suspended, revoked, or expired.
3. Description of Service and Scope
Sehat Doc provides a Software-as-a-Service (SaaS) solution designed for patient record management, digital prescriptions, laboratory integration, and financial tracking for clinics.
Medical Disclaimer: The Service is a data-processing tool only. It is not an Electronic Medical Assistant or an autonomous diagnostic tool. Sehat Doc does not provide medical advice, diagnosis, or treatment. The professional practitioners using the Service are solely responsible for the clinical accuracy of the data entered and the medical decisions made based on that data.
4. Account Security and Usage
You are responsible for maintaining the confidentiality of your account credentials, including passwords for yourself and any secondary staff accounts you create.
- Authorized Access: You shall not share your individual account credentials with any third party.
- Staff Responsibility: If you are a Clinic Owner or Admin, you are legally responsible for all actions taken by receptionists, doctors, or staff members under your clinic's subscription.
- Breach Notification: You must immediately notify Sehat Doc of any suspected unauthorized access or security breach.
5. Regulatory Compliance (PECA 2016)
In accordance with the Prevention of Electronic Crimes Act (PECA) 2016, you agree not to use the Service for any illicit activity. Prohibited activities include but are not limited to:
- Accessing the Service to compromise the privacy of any individual without their express consent.
- Storing or transmitting non-consensual images or recording private data which violates local decency or privacy laws.
- Interfering with the operation of the Service through the introduction of malware or denial-of-service (DoS) attacks.
Violation of these terms may result in immediate account termination and reporting to the Federal Investigation Agency (FIA) or other relevant authorities.
6. Data Ownership and Privacy
User Content: All patient data, clinical notes, and clinical history entered into the Service remain the property of the User or the Healthcare Entity. Sehat Doc claims no ownership over your patient data.
Data Use: You grant Sehat Doc a limited license to process, store, and transmit your data as necessary to provide the Service. We may use anonymized, aggregated data for internal research, system improvement, and statistical analysis as detailed in our Privacy Policy.
Sehat Doc strictly complies with HIPAA-level standards for data encryption and does not share your identifiable clinical data with third-party pharmaceutical or insurance entities without express written authorization.
7. Fees, Payments, and Taxes
Use of the Service requires a valid, paid subscription after any initial trial period expires.
- Subscriptions: Fees are non-refundable and are charged in advance on a monthly or annual basis.
- Local Taxation: Prices mentioned on the platform are inclusive of PKR/USD as stated. The User is responsible for any additional local provincial taxes (e.g., PRA, SRB, or FBR withholding taxes) if applicable.
- Modification of Fees: Sehat Doc reserves the right to modify subscription pricing with at least thirty (30) days' advance notice to the primary account holder.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Sehat Doc, its directors, and employees shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of clinic revenue, medical malpractice claims, or loss of medical records due to catastrophic server failure or external hacking.
Our total liability for any claim arising under these Terms shall not exceed the total amount paid by you to Sehat Doc in the twelve (12) months preceding the claim.
9. Jurisdiction and Dispute Resolution
This Agreement is governed by the laws of Pakistan. Any dispute, controversy, or claim arising out of or relating to this agreement shall be settled by arbitration in accordance with the Arbitration Act 1940. The venue for arbitration and any subsequent legal proceedings shall be the courts of Islamabad or Lahore, Pakistan.
10. Termination and Suspension
We reserve the right to suspend or terminate your account at our sole discretion for any violation of these Terms or for non-payment of subscription fees. Upon termination, we will provide a grace period of fifteen (15) days for the Subscriber to export their patient data in CSV or PDF format.
